Terms of Service

These Terms of Service constitute a binding agreement between you and SwiftQuote, governed by the laws of the Republic of South Africa, including the Electronic Communications and Transactions Act 25 of 2002 (ECT Act) and the Consumer Protection Act 68 of 2008 (CPA).

1. Acceptance of Terms

By registering for or using SwiftQuote ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including free trial users and paid subscribers.

If you are using SwiftQuote on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. The Service

SwiftQuote is a cloud-based quoting and invoicing platform that enables contractors and small businesses in South Africa to:

  • Generate professional PDF quotes and invoices using AI assistance.
  • Store and manage client and quote records.
  • Track quote and payment status.
  • Customise documents with their own branding.

We reserve the right to modify, suspend, or discontinue the Service or any feature at any time, with reasonable notice to active subscribers.

3. Account Registration

You must provide accurate, complete, and current information when registering. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You must notify us immediately at info@swiftquote.co.za if you suspect any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that provide false information or that are used in violation of these Terms.

4. Free Trial

New users receive a 7-day free trial with full access to all features. No credit card is required to start a trial. At the end of the trial period, access to the Service will be restricted unless you subscribe to a paid plan.

Trial accounts remain bound by all provisions of these Terms.

5. Subscription and Payment

SwiftQuote offers two payment options. All payments are processed by PayFast, a South African payment gateway. In terms of Section 44 of the ECT Act, transactions concluded electronically are valid and binding.

Monthly Subscription — R199/month

By subscribing, you authorise PayFast to debit your chosen payment method on a recurring monthly basis.

  • Subscriptions auto-renew monthly unless cancelled.
  • You may cancel at any time from within your account settings. Cancellation takes effect at the end of the current billing period.
  • No partial refunds are issued for unused days within a billing period.
  • We reserve the right to adjust pricing with 30 days written notice to active subscribers.

Pay-as-you-go Credit Bundles

Users who prefer not to subscribe monthly may purchase credit bundles as a one-off payment. Credits are added to your account immediately upon confirmed payment.

  • Available bundles: 10 quotes (R49), 30 quotes (R99), 100 quotes (R249).
  • One credit is deducted per quote, invoice, or job card generated.
  • Credit bundle purchases are one-off payments — no recurring billing.
  • Credits are valid for 6 months from the date of purchase. Unused credits expire after this period.

6. Refund Policy

In accordance with the Consumer Protection Act, if the Service is materially defective or fails to perform as described, you may request a refund within 10 business days of the date of the affected transaction. All refund requests must be submitted to info@swiftquote.co.za with a description of the issue.

Refunds will not be issued for change-of-mind cancellations after the 7-day free trial period.

Pay-as-you-go credits are non-refundable and non-transferable. Once a credit bundle has been purchased, no refunds will be issued for unused credits, regardless of the reason, including but not limited to change of mind, account cancellation, or expiry. Credits expire 6 months from the date of purchase and hold no monetary value after expiry.

7. Acceptable Use

You agree not to use SwiftQuote to:

  • Create fraudulent or misleading quotes or invoices.
  • Violate any applicable South African law, including the Prevention and Combating of Corrupt Activities Act or the Financial Intelligence Centre Act.
  • Upload or transmit harmful, defamatory, or unlawful content.
  • Attempt to reverse-engineer, copy, or resell the Service.
  • Interfere with the operation or security of the platform.

We reserve the right to immediately suspend accounts found to be in breach of this clause.

8. Your Content

You retain full ownership of all content you create within SwiftQuote, including your business profile data, client records, and quotes. By using the Service, you grant us a limited licence to store, process, and display your content solely for the purpose of providing the Service to you.

You are solely responsible for the accuracy and legality of the information you enter and the documents you generate.

9. AI-Generated Content

SwiftQuote uses artificial intelligence (OpenAI) to assist with parsing quote descriptions. AI-generated output is a starting point only. You are responsible for reviewing and verifying all line items, amounts, and client details before saving or sending any quote or invoice. SwiftQuote accepts no liability for errors in AI-generated content that you approve and send.

10. Intellectual Property

SwiftQuote, including its design, code, branding, and features, is the intellectual property of Stainless Charm (Pty) Ltd / SwiftQuote and is protected under South African copyright law. Nothing in these Terms grants you any right to use our trademarks, logos, or branding.

11. Limitation of Liability

To the maximum extent permitted by South African law, SwiftQuote and its operator shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service, including loss of income, loss of data, or business interruption.

Our total liability to you for any direct damages shall not exceed the amount you paid to us in the 30 days preceding the event giving rise to the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, as these cannot be excluded under South African law.

12. Service Availability

We aim to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where reasonably possible. We are not liable for downtime caused by factors outside our reasonable control, including third-party service failures, internet disruptions, or force majeure events.

13. Termination

Either party may terminate the agreement at any time. You may delete your account via the platform or by contacting us. Upon termination:

  • Your access to the Service will cease at the end of the current billing period (for paid accounts).
  • Your data will be retained for 30 days post-termination and then permanently deleted, unless required by law.
  • No refunds will be issued for the remaining portion of the billing period.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of SwiftQuote shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be referred to mediation in terms of the Arbitration Act 42 of 1965, or as agreed between the parties.

You consent to the jurisdiction of the Magistrate's Court or High Court of South Africa having jurisdiction over your place of domicile for any legal proceedings.

15. Changes to These Terms

We may update these Terms from time to time. We will notify active subscribers of material changes by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance. If you do not agree to the revised Terms, you may cancel your subscription before the effective date.
